For the reasons discussed on the record at the conference on November 21, 2025, the Defendant’s request for a nunc pro tunc extension of time to serve his Requests for Production and Interrogatories, and an extension of fact discovery is GRANTED. By Monday, November 24, 2025, Defendant shall serve on Plaintiff a corrected RFP and Interrogatories. Counsel are directed to confer within a reasonable time after receiving those corrected requests, to discuss the time to comply with the requests, discuss any further clarification or corrections, and agree on a schedule of interim deadlines for fact discovery in this case. Fact discovery is extended until April 17, 2026. All counsel should assume that no further extensions of this deadline will be granted. The post−fact−discovery conference previously scheduled for February 26, 2026 is ADJOURNED to Thursday, May 21, 2026 at 9:30 a.m. Counsel are directed to the Court’s Individual Rules for the correspondence required between the close of fact discovery and this conference. Finally, because the filings on this issue contain personal medical information of Defendant’s counsel, the Court finds that sufficient to overcome the presumption of public access to judicial documents and the request to seal Dkt. 2/2/2026 – 42: ORDER granting 40 Letter Motion to Seal; granting 41 Letter Motion to Continue: Due to medical unavailability of counsel, Defendant’s requests to adjourn Plaintiff’s deposition and extend the discovery deadline are GRANTED. Plaintiff’s deposition is ADJOURNED until a date on or after March 25, 2026 at a time agreed-upon by all parties. Additionally, the deadline to complete fact discovery is EXTENDED until June 1, 2026. The Court will NOT extend these dates again, absent extraordinary circumstances, unrelated to counsel’s health, that could not have been anticipated as of the date of this Order. If current counsel for Defendant is unable to meet these new deadlines due to his medical situation, he must either withdraw in sufficient time for another attorney to meet these deadlines or seek the assistance of an additional attorney to meet these deadlines. Finally, because Dkt. No. 41 contains personal medical information of Defendant’s counsel, the Court finds that sufficient to overcome the presumption of public access to judicial documents and the request to seal Dkt. 41 is GRANTED. SO ORDERED. (HEREBY ORDERED by Judge Margaret M. Garnett)(Text Only Order)
